This happens all the time. It's almost never plagiarism.

People who don't create regularly can sometimes fall into the trap of thinking all their ideas are unique and beautiful. Once you've been writing, drawing, painting or whatever for a while you come to realize that none of your ideas are that original and what counts is how you execute the actual art piece.

There are tons of paintings of the night sky but Van Gogh still created a unique and beautiful piece of art from it because of his skill and technique.

If you look around long enough you can always find another piece like yours. Especially when you're focusing on a very specific subject.

True, especially when the webcomic blogosphere seems to be lit up this week due to Hot Topic stealing the art from some webcomic people and repurposing it for their shirts. The shirt drawing is exactly the same, but the "joke" is a bit different (it went from lesbians to zombies, I think.) and it is more egregious than if they had used a similar gag but drawn the photo their own damn selves :D

Yeah, it's unfortunate that the joke we did was similar to one that Penny Arcade did a couple years back (especially considering how I labored over the script for this one... if I HAD plagaraized it, it would have been much easier for me!) but pretty much inevitable.

But I find the notion of a disclaimer stating that the similarities are unintended funny. As if someone who does plagarize would say they plagarized something...

Yeah, the Hot Topic stuff is blatant. It's not about an idea being reused, they're just taking art whole cloth or tracing it and adding a couple of bits.

I want to saw that your "25 hours" joke on FF13 is excellent. I cracked up, and I haven't even played the game or watched 24. Great joke.
